These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and SCRIBBLESCAN LLC, doing business as ScribbleScan ("ScribbleScan", "we", "us", or "our"), concerning your access to and use of the https://scribblescan.app/ website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site"). We are registered in Washington, United States and have our registered office at 100 N HOWARD ST STE R, SPOKANE, WA 99201. You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service from time to time. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
Our Service is designed with awareness of key privacy laws relevant to the education sector, including but not limited to the Family Educational Rights and Privacy Act (FERPA), the Children's Online Privacy Protection Act (COPPA), and applicable state student privacy laws.
We act primarily as a service provider to our users, who may include educational institutions, teachers, or parents ("Account Holders"). We commit to processing personal information, including any "education records" (as defined by FERPA) or personal information of children under 13 (as defined by COPPA) that you may input into our Service, solely for the purpose of providing and improving the Service as outlined in these Terms.
- Ephemeral Data: Uploaded handwritten document images are processed in temporary memory only and are never written to persistent storage. These images exist only during active processing and are automatically purged from memory upon completion of digitization processing or session termination.
- Digitized Output: The resulting digitized text output is provided directly to the Account Holder for immediate export and download. We do not store or retain any digitized text content on our servers - it is the Account Holder's responsibility to save and manage their digitized content locally.
- Account Data: We store only essential account information (email, subscription details, usage limits) necessary for account management and service delivery.
- Processing Location: Our application infrastructure is hosted on Google Cloud Platform within the United States, with account data stored on Supabase. Third-party AI services used for digitization processing may be subject to their own terms of service and privacy policies, which Account Holders should review independently.

It is not intended or designed for processing official educational records, student transcripts, formal assessments, or other documents requiring certified accuracy or special regulatory compliance.
While we implement standard security practices for all users, we do not provide specialized handling procedures for FERPA-covered education records. Educational institutions considering our Service should:
- Evaluate whether their intended use involves "education records" as defined by FERPA
- Implement their own additional safeguards if processing official educational records
- Consider whether our general-purpose tool meets their specific compliance requirements
- Understand that we process all documents using the same standard procedures regardless of content type
We implement administrative, technical, and physical safeguards including:
- User passwords are hashed before transport to database
- Row-level security (RLS) policies ensuring users can only access their own data
- Authenticated access controls for user operations
- Hosting infrastructure via Google Cloud Platform with account data stored on Supabase
- Application monitoring and error logging
- Restricted database permissions with role-based access control
Security Limitations: We do not implement end-to-end encryption, field-level database encryption, or specialized audit logging beyond standard application monitoring. Educational users access our Service exclusively through our web interface.
Account Holders who use our Service with students, particularly those under 18 or whose data constitutes "education records," are solely responsible for:
- Legal Compliance: Ensuring compliance with all applicable privacy laws, including FERPA, COPPA, and relevant state student privacy laws such as California Student Privacy Rights Act, New York Education Law § 2-d, and similar statutes.
- Required Consents: Obtaining all necessary consents, including:
- Parental consent under COPPA for children under 13
- Student/parent notification as required by FERPA
- Any additional consents required by state or local laws
- Authority Verification: Confirming they have legal authority to submit student data for processing and that such submission complies with their institutional policies and applicable laws.
- Data Governance: Implementing appropriate internal controls for student data submitted to our Service.
In the event of any security incident involving student data:
- We will notify affected Account Holders within 72 hours of discovery
- We will provide detailed incident reports including scope, cause, and remediation steps
- We will cooperate fully with Account Holders' own notification obligations under applicable laws
- We will implement additional safeguards as necessary to prevent recurrence
While we are committed to supporting our users' compliance efforts, the ultimate responsibility for compliance with education and student data privacy laws rests with the Account Holder. We commit to:
- Providing technical and administrative assistance to support Account Holders' compliance obligations
- Responding promptly to reasonable requests for information needed for Account Holders' privacy assessments
Important Notice: Our handwriting digitization service uses artificial intelligence technology that, while advanced, is not perfect. The digitized output may contain errors, omissions, or inaccuracies compared to the original handwritten content. Account Holders are responsible for:
- Reviewing and verifying all digitized content for accuracy before use
- Understanding that our Service provides a digitization tool, not a guarantee of perfect transcription
- Not relying solely on our digitized output for important decisions without independent verification of accuracy
Account Holders should verify digitized content when accuracy is important.
Data Retention Reality: Given our data processing model where handwritten images are processed in memory only and digitized output is not stored on our servers, there is typically no personal data for us to access, correct, or delete after processing is complete.
Account Data Only: Data subject rights apply primarily to stored account information (email addresses, subscription details, usage records). For this limited account data, we will:
- Provide access to account holders upon request
- Allow correction of account information
- Delete accounts and associated data upon request
Educational Context: Since we do not store processed documents or maintain education records, traditional FERPA inspection rights and COPPA parental access rights do not typically apply to our processing activities. Account Holders remain responsible for managing any downloaded digitized content according to their own legal obligations.
By using our Service with student data, Account Holders acknowledge they have reviewed and understand these commitments and confirm their authority to submit such data consistent with all applicable legal requirements. Account Holders further acknowledge the service limitations described above and agree to use appropriate verification procedures when accuracy is important.
The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site.
